By accessing or using any website, application, or service operated by Awesome Machinery, LLC ("AwesomeMachinery," "we," "us," or "our"), collectively the "Services," you agree to be bound by these Terms of Service. If you do not agree, do not use the Services.

Certain features of the Services may require payment. All payments are processed securely by Stripe. By providing payment information, you represent that you are authorized to use the payment method.

Prices are listed in the Services and may change with notice. Unless otherwise stated, all fees are non-refundable. If you believe a charge was made in error, contact us at hello@awesomemachinery.com and we will review it on a case-by-case basis.

The Services and all associated content, features, and functionality are owned by Awesome Machinery, LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Services without our prior written consent.

6. Disclaimer of warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

7. Limitation of liability

To the fullest extent permitted by law, Awesome Machinery, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Services. Our total liability for any claim arising from these Terms or your use of the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless Awesome Machinery, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services or violation of these Terms.

9. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services ceases immediately.

10. Governing law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.
